【Ministry of Education】Forwarding the Ministry of Labor’s Amendments to the “Regulations on the Permission and Administration of the Employment of Foreign Workers by Employers”

  1. This matter is handled in accordance with the Ministry of Labor’s letter dated August 26, 2024 (Ref. No. 1130512898D), as attached.

  2. To address labor shortages in the hospitality industry and support Taiwan’s talent retention and recruitment policies, the Ministry of Labor has amended certain provisions of the aforementioned regulations. Key amendments include:

    (1) Foreign students, overseas Chinese students, and other ethnic Chinese students who have obtained an associate degree or higher from a college or university in Taiwan may be employed by legally registered tourist hotels, hotels, and bed-and-breakfast establishments to perform hospitality services, including housekeeping, cleaning, reservations, reception, and restaurant front-of-house services. (Amended Article 2)

    (2) Corresponding amendments have been made to the required supporting documents for employers applying to employ foreign workers for hospitality services. (Amended Article 44)

    (3) Foreign students, overseas Chinese students, and other ethnic Chinese students who have obtained an associate degree or higher from a college or university in Taiwan may change employers or jobs after the employment period for hospitality services expires and is not extended. (Amended Article 48)

    (4) The validity period of work permits for fourth-category foreign workers has been revised. (Amended Article 54)
